Battery law

The battery law is regarding the realization of the battery directive in national law. The manufacturers of device batteries have to ensure the obligation to take back and recycle batteries that they take part in a mutual, non-profit-oriented and area-covering take-back system for used device batteries. The manufacturers and importers must mark the batteries and accumulators with the symbol of a crossed-out bin and inform the Federal Environmental Agency about how many batteries or accumulators had been sold in the previous month.

Battery directive

The battery directive is the directive of the European parliament and of the Council about batteries and accumulators. The directive includes regulations about the commissioning of batteries and accumulators as well as the prohibition to sell batteries which include harmful substances. Moreover, the battery directive aims at improving the collection, treatment, disposal and recycling of used batteries and used accumulators by the involved commercial actors, i.e. manufacturers, end users and waste removers. In Germany it was implemented battery law in national law. The battery directive only applies for member states of the EU and was implemented in a different way in each country.

CE marking

The intention of the CE marking (Conformité Européenne) is to indicate to the user within the European economic area that the purchased product complies with the applicable European guidelines. As part of the directives of the Single European Market they determine certain minimum requirements in the safety and health properties of numerous products. With the CE marking and a corresponding procedure to evaluate the conformity, the manufacturers confirm that the products comply with all directives and minimum requirements which are applicable for such products. The CE marking is a condition for the initial commissioning of products within the European economic area, which are subject to the European directives. In spite of this, the CE marking is no seal of quality regarding the quality of the products and does not allow to draw conclusions if an independent authority took part in the procedure of evaluation of conformity of the products.

The European Chemical Agency (ECHA) in Helsinki assumes the administration of REACH. RoHS

On January 27th, 2003 the European Parliament and the Council published the directive 2002/95/EC for limitation of use of certain hazardous substances in electrical devices and electronic equipment. In Germany, the Electrical and Electronic Equipment Act which was issued on March 16th, 2005 includes the WEEE directive as well as the RoHS directive. Any environmental and health hazardous substances of content which are for instance acting toxic or which can only be badly decomposed should be proscribed from the products. The substances of content regarded are lead, mercury, hexavalent chromium, PBB and PBDE of which maximum 0.1 percent of weight may be included each. The amount of cadmium must only amount to 0.01 percent of weight. Furthermore, the introduction of environmentally friendly replacements should be conveyed. Packaging ordinance

The packaging ordinance is the directive of the European Parliament and of the Council regarding packaging and waste from packaging according to the Act on the Closed Substance ´Cycle and Waste Management (KrW/AbfG) (Waste Act). This directive aims to avoid or reduce the effects of waste from packaging on the environment. In order to ensure the achievement of the objectives, the packaging ordinance was last modified by its 5th amendment. Since January 1st, 2009, it additionally prescribes obligations for the concerned companies, in particular for mail order companies and Internet traders. In the packaging ordinance the legislator distinguishes between sales packaging, wholesale packaging and transport packaging. The sales packaging generally includes all packaging which accrue at the premises of the "private end user". I.e. bubble envelopes, wrapping films and wood wool. The directive concerns all "manufacturers and traders who initially commission the sales packaging filled with goods. They have to participate in the Dual System acting on the German market which shall ensure the licensing of the packaging. Furthermore, the market participants in Germany are obliged to submit a completeness statement about the sold packaging quantities to the German chamber of commerce, if certain material-dependent quantity thresholds are being exceeded (80 t of glass, 50 t of paper, cardboards and cardboard packaging, as well as 30 t of other materials).
